Senator H. Dan Morias Introducese a Bill to compel Presidential Nominee To Be Confirmed By the Senate Before Taking Office.
Maryland County Senator H. Dan Morias has introduced a Bill in the Liberian Senate. The Bill entitle: “A BILL GUIDING THE PERIOD A PERSON NOMINATED BY THE PRESIDENT, REPUBLIC OF LIBERIA UNDER ARTICLE 54 OF THE CONSTITUTION OF LIBERIA”. The Bill when pass into law will guide public officials nominated by the President of Liberia to go through confirmation procedures before ever taking office officially. Below is the bill.
A BILL GUIDING THE PERIOD A PERSON NOMINATED BY THE PRESIDENT, REPUBLIC OF LIBERIA UNDER ARTICLE 54 OF THE CONSTITUTION OF LIBERIA.
Whereas, the constitution of Liberia mandates the president of Liberia to nominate candidates for position prescribed in Article 54 and subject to confirmation by the Liberian Senate;
Whereas, the constitution of Liberia mandates the Legislature (Article 34 L) shall have the power '' to make other Laws which shall be necessary and proper for carrying into execution to the foregoing powers vested by this constitution in the Government of the Republic, or in any department or officer thereof'';
Whereas, the constitution of Liberia also mandates that each house shall adopt it's own rules of procedure, enforce order (Article 38);
NOW THEREFORE, it is enacted by the Senate and the house of Representatives of the 53rd legislature of the republic of Liberia in legislature Assembled:
1.That individual nominated by the President must be received by the Senate no later than 10 working days as if the date if the nomination.
2.Persons nominated while the Senate is on recess shall act until the return of the senate from recess, but the nominate shall not act over a period of two Months after the resumption if session of the Senate.
3.No nominee (s) shall assume office or act over two months while the senate is in session pending confirmation.
ANY LAW TO THE CONTRARY NOT WITH STANDING
This act takes immediate effect upon publication into Handbill.
